SI 2018-181 Proclamation 6-2018 Appointment of Commission of Inquiry into 1st August 2018 post-Election Violence

This proclamation was signed by President Mnangagwa on 12th September 2018 and published in a Government Gazette Extraordinary dated 14th September. The commissioners were sworn in on 19th September.

I, PRISCILLA MAKANYARA CHIGUMBA, in my capacity as the Chairperson of the Zimbabwe Electoral Commission and by due authority of the Zimbabwe Electoral Commission and that of the 25th respondent, hereby take oath and state that the facts I depose to hereunder are within my personal knowledge and belief and are true and correct. Where I relate to issues of a legal nature, I do so on advice from counsel which advice I accept.

This court application was filed in the Constitutional Court on Friday 10th August.  Respondents 2 to 22 were the other candidates in the Presidential election on 30th July.

Time Frame for a Presidential Challenge

In the early hours of the morning on 3rd August, the chairperson of the Zimbabwe Electoral Commission [ZEC] declared Mr Mnangagwa to have been duly elected as President of Zimbabwe.  The MDC Alliance has said the result will be challenged in court.

GN 2018 - 370B - ZEC Notice fixing 29th May 2018 as the Date on which the New BVR Voters Roll Became the Definitive Voters Roll

Section 36A(2)(a) of the Electoral Act provides that when a new voters roll is produced after the conclusion of a new registration of voters, the new roll will, with effect from such date as the Zimbabwe Electoral Commission [ZEC] must fix by notice in the Gazette, be the definitive voters roll on the basis of which the continuous registration of voters in terms of section 17A shall be conducted.

A new registration of voters was ordered by SI 109/2017 and launched on 14th September 2017.

Presidential Ballot Paper

It appears that the Zimbabwe Electoral Commission [ZEC] has printed presidential ballot papers with the presidential candidates listed in alphabetical order in two columns.  The President’s name, which would be towards the middle of a single column, heads the second column.

Postal Voting

Reports of police officers in Bulawayo casting postal votes under the watchful eyes of their superior officers have raised questions about the postal voting system.  In this Election Watch we shall explain how the system is supposed to work.  We shall also explain that there are differences between how postal voting is done in this election and how it used to be done.
