Note by Veritas: This text of the Local Government Laws Amendment Bill, (H.B 1, 2016) which was at Second Reading Stage was replaced with a new text on 28 June 2016. The new text incorporates the amendments which address the issues raised by the Parliamentary Legal Committee on the initial text of the Bill. The new text is the basis upon which the Parliamentary Legal Committee issued a non-adverse report on the Bill.

EXPLANATORY MEMORANDUM


The purpose of this Bill is to ensure that all Acts of Parliament in force before the new Constitution became effective are, to the extent of any inconsistency with the Constitution, aligned with the Constitution. The changes are mostly of a minor nature. The opportunity has also been taken to resolve some minor anomalies in the statute book. The more important amendments are the subject of the commentary below.

Finance (No. 2), 2015

A Bill to make further provision for the revenues and public funds of Zimbabwe and to provide for matters connected therewith or incidental thereto. This Bill will amend the Finance Act [Chapter 23:04], the Income Tax Act [Chapter 23:06], the Value Added Tax Act [Chapter 23:09] and other Acts.

Explanatory Memorandum


This Bill seeks to provide for the establishment of the Special Economic Zones Authority and to provide for the functions thereof; to provide for the constitution and functions of the Special Economic Zones Board; to provide for the establishment of Special Economic Zones, the administration, control, regulatory measures and incentives.

The individual clauses of the Bill are explained below:

Zimbabwe National Defence University Bill - HB 12-2015

The purpose of this Bill is to establish the Zimbabwe National Defence University and to provide for matters incidental to or connected with the foregoing. The main provisions of the Bill are explained below:

Part I
Clause 1 sets out the short title. Clause 2 provides the definition of terms used in the Bill.
 

Part II
Clauses 3 and 4 provides for the establishment of the University and the objects and powers of the University.
 

Zimbabwe Gender Commission Bill [H.B. 8A, 2014] (Amended)

This Bill seeks to establish a Gender Commission as provided for in section 245 of the Constitution of Zimbabwe which creates an independent institution called the Zimbabwe Gender Commission. It also seeks to fulfil international and regional instruments thatZimbabwe is a party to, namely: the Universal Declaration of Human Rights, the Convention on the Elimination of all forms of Discrimination Against Women (CEDAW) and the Beijing Declaration and Platform for Action.

Banking Amendment Bill, 2015

This Bill will amend the Banking Act [Chapter 24:20] to enable it to deal more effectively with developments in the financial sector and in particular, to achieve the following objectives:
- to improve the corporate governance of banking institutions.
- to make banking institutions more responsive to their customers needs and to encourage the resolution of disputes between banks and their customers.
- to introduce greater transparency, in the shareholding and operations of banking institutions.

Labour Amendment Bill, 2015

The Labour amendmcnt Bill has come about in recognition of the need not only to align labour law's with the Constitution, in particular section 65 on Labour rights but also to promote productivity and competitiveness of local industry,- A consultative process was carried out by Government, by including its two social partners, labour and business. Together the tripartite partners come up with a draft amendment Bill.
