HIGH COURT ACT [CHAPTER 7:06]


Creation of the Anti-Corruption Division of the High Court


NOTICE is hereby given, in terms of section 46A of the High
Court Act [Chapter 7:06], that in the interests of expediting justice
delivery and after consulting the Judge President, I have created
a specialised division of the High Court to be known as the Anti-
Corruption Division of the High Court.

The Anti-Corruption Division of the High Court shall be responsible
for adjudicating on all matters in which corruption or abuse of office
is an element, including—

(a) criminal trials and other matters arising out of or connected
with criminal trials; and
(b) civil cases arising out of instances of corruption or abuse of
office; and
(c) reviews, applications and appeals from magistrates courts in
cases where corruption or abuse of office is an element;

and, for the purpose of this notice—“

abuse of office” includes—

(a) conduct specified in section 174 of the Criminal Law
(Codification and Reform) Act [Chapter 9:23] as
constituting criminal abuse of duty as a public officer;
and
(b) any conduct on the part of an agent, other than a public
officer, which would amount to criminal abuse of duty
as a public officer if the agent were a public officer;

“agent” has the meaning given to it in section 169 of the Criminal
Law (Codification and Reform) Act [Chapter 9:23];

“corruption” includes—

(a) conduct specified in sections 170 to 173 inclusive
of the Criminal Law (Codification and Reform) Act
[Chapter 9:23]; and
(b) any other dishonest conduct committed by an agent in
his or her capacity as such.
