Prosecutorial Guidelines 2021

These guidelines were issued by the Prosecutor-General in a Schedule to General Notice 2759 of 2021, published on the 24th September, 2021 [link]. They were issued in terms of section 260(2) of the Constitution, which states:
“(2) The Prosecutor-General must formulate and publicly disclose the general principles by which he or she decides whether and how to institute and conduct criminal proceedings.”
In reproducing the guidelines, Veritas has adjusted the layout, inserted a table of contents, corrected a few typographical errors and reduced the capitalisation. The contents and substance have not been changed.
