Linda T Masarira v Presiding Officer of the Nomination Court and Ors: Appellant's Heads of Argument on Appeal to Judge in Chambers

Introduction

1. Appellant presented herself for nomination as a presidential candidate in terms of section 92 of the Constitution, as amended.
2. The election in question is set to be held on 23 August 2023 by virtue of Proclamation Number 4 of 2023 published in Statutory Instrument 85 of 2023.
3. In terms of the said Proclamation, 21 June 2023 was set as the date on which the Nomination Court would sit for the purpose of receiving nominations from persons who wished to contest in those elections as candidates.
4. Appellant's nomination papers were rejected by the lst Respondent.
5. In rejecting Appellant's nomination papers, 1st Respondent cited the non-payment of nomination fees by Appellant.
